Item 6 – UPR Outcome of Libya

The World Organisation Against Torture & The Libyan Anti-Torture Network

Mr. President,

The World Organisation Against Torture and the Libyan Anti-Torture Network take note of Libya’s UPR outcome. While we acknowledge the government's stated commitments, a critical gap persists between international pledges and the reality on the ground.

Reports of arbitrary detention and torture in places of deprivation of liberty remain deeply concerning. The absence of independent oversight continues to fuel impunity. Therefore, structural reform is critical.

Specifically, we call on the Libyan authorities to:

First, ratify the Optional Protocol to the Convention against Torture (OPCAT). Ratification is a necessary step to establish a formal preventive framework and signal a genuine commitment to international standards.

Second, establish a National Preventive Mechanism (NPM). This mechanism must be functionally independent and granted a clear legislative mandate to conduct unannounced, unfettered visits to all places of deprivation of liberty.

Third, ensure prompt, impartial, and independent investigations into all allegations of torture and hold perpetrators accountable.

Without these institutional safeguards, the cycle of impunity will continue. We urge the Libyan government to prioritize these steps to ensure the dignity of all individuals under its jurisdiction.
