Arbitrary arrest of five members of the Federation of Trade Unions of Burma

The Observatory for the Protection of Human Rights Defenders, a joint programme of the World Organisation Against Torture (OMCT) and the International Federation for Human Rights (FIDH), requests your urgent intervention in the following situation in Burma.

Description of the situation:

The Observatory has been informed by the International Trade Union Confederation (ITUC) about the arbitrary arrest by the Burmese military junta of five members of the Federation of Trade Unions of Burma (FTUB), namely Mr. U Zaw Myint Aung, Mr. U Soe Oo, Mr. Maung Tun Nyein, Ms. Khine Lin Myat and Ms. Shwe Yi Nyunt. All are campaigners for workers’ rights and for the improvement of wages and working conditions for workers inside Burma.

According to the information received, on April 1, 2009, Mr. U Zaw Myint Aung, Mr. U Soe Oo, Mr. Maung Tun Nyein, Ms. Khine Lin Myat and Ms. Shwe Yi Nyunt, also a member of FTUB Women’s Committee, were arrested at their places of residence in Rangoon as they returned home from the First National Congress of the FTUB, which ended on March 24.

The five FTUB are likely to be held in interrogation centres in the Rangoon area, where it is feared they may be subjected to torture. To our knowledge, as of issuing this urgent appeal, the reasons for their arrest remained unknown.

The Observatory was further informed that an unspecified number of family members of these five human rights defenders persons were also arrested, threatened and put under pressure in an effort by the authorities to compel cooperation from the five detained FTUB members.

Since its foundation in 1991, FTUB has worked to end violations of fundamental trade union and other human rights, notably the systematic use of forced labour by the military.

The Observatory expresses its deepest concern about the arbitrary arrests of Mr. U Zaw Myint Aung, Mr. U Soe Oo, Mr. Maung Tun Nyein, Ms. Khine Lin Myat and Ms. Shwe Yi Nyunt, as they seem to merely aim at sanctioning their human rights activities, and further evidence the extremely repressive environment for human rights defenders in the country. The Observatory therefore calls for their immediate and unconditional release.

Action requested:

Please write to the Burmese authorities urging them to:

  1. Guarantee in all circumstances the physical and psychological integrity of Mr. U Zaw Myint Aung, Mr. U Soe Oo, Mr. Maung Tun Nyein, Ms. Khine Lin Myat and Ms. Shwe Yi Nyunt, as well as of all their relatives;
  2. Release Mr. U Zaw Myint Aung, Mr. U Soe Oo, Mr. Maung Tun Nyein, Ms. Khine Lin Myat and Ms. Shwe Yi Nyunt as well as their relatives immediately and unconditionally since their detention is arbitrary as it merely aims at sanctioning their human rights activities;
  3. Put an end to all acts of harassment - including at the judicial level - against Mr. U Zaw Myint Aung, Mr. U Soe Oo, Mr. Maung Tun Nyein, Ms. Khine Lin Myat and Ms. Shwe Yi Nyunt as well as against their relatives and all human rights defenders in Burma;
  4. Conform with the provisions of the UN Declaration on Human Rights Defenders, especially its article 1, which states that “everyone has the right, individually and in association with others, to promote and to strive for the protection and realisation of human rights and fundamental freedoms at the national and international levels” as well as Article 12.2, which provides that “the State shall take all necessary measures to ensure the protection by the competent authorities of everyone, individually and in association with others, against any violence, threats, retaliation, de facto or de jure adverse discrimination, pressure or any other arbitrary action as a consequence of his or her legitimate exercise of the rights referred to in the present Declaration”;
  5. Ensure in all circumstances respect for human rights and fundamental freedoms in accordance with international human rights standards and international instruments ratified by Burma.
