Call for the immediate release of disappeared human rights lawyer Khalil Ma’touq

Khalil Ma’touq, the director of theSyrian Centre for Legal Studies and Research, disappeared on 2 October 2012,along with his colleague Mohammed Thatha, as they were on their way to work inthe capital Damascus. It is believed they were detained at a governmentsecurity checkpoint.

A number of unofficial tip-offs have indicatedthat Khalil Ma’touq has been held in different detention centres in Damascus, buthis and Mohammed Thatha’s fate and whereabouts remain unknown. Despite repeatedrequests from family and lawyers, the Syrian authorities continue to deny theyare in custody, placing them at particular risk of torture or otherill-treatment and extrajudicial execution.

Enforced disappearances are crimes underinternational law and their use in Syria has been strongly condemned by the UNSecurity Council, which in their resolution of February 2014 also demanded “theimmediate end of these practices and the release of all arbitrarily detainedpersons.”

The fact that there is no informationregarding the current situation of Khalil Ma’touq is a cause of immense concernto his family and to the undersigned organizations, in particular as unofficialinformation has indicated he is in extremely poor health. He suffers fromadvanced lung disease and has severe breathing difficulties.

The undersigned organizations considerboth men to have been subjected to enforced disappearance. They believe that KhalilMa’touq was targeted because of his legitimate and peaceful work in defence ofhuman rights and that Mohamed Thatha’s disappearance seems to be linked to hiswork with the human rights lawyer.

Theundersigned organizations call on the Syrianauthorities to immediately andunconditionally release Khalil Ma’touq. Mohammed Thatha should also similarlybe released if, as it appears, he has been detained for his work in the fieldof human rights or for peacefully exercising his right to freedom of expression.

The organizations also call on the member states of the UN Security Council to ensure theeffective implementation of resolution 2139, including by immediately employingall relevant mechanisms to ensure that all arbitrarily detained persons arereleased.

ندعو إلى الإفراج الفوري عن محاميحقوق الإنسان المفقود الأثر خليل معتوق

بعد مرور سنة ونصف على اختفاء محامي حقوق الإنسان السوريالمعروف، خليل معتوق، تكرر المنظمات الموقعة ادناه التأكيد على دعوتهم السلطاتالسورية إلى الإفراج عنه فورا ودون شروط.

اختفى خليل معتوق، مدير المركز السوري للدراسات والأبحاثالقانونية، في 2 أكتوبر/تشرين الأول 2012، جنباً إلى جنب مع صديقه ومساعده، محمد ظاظا. ويعتقد انهما قداعتقلا عند نقطة تفتيش أمنية حكومية وهم في طريقهم الى العاصمة دمشق للعمل.

وقد أشارت عدد من التلميحات غير الرسمية الى أن خليلمعتوق قد احتجز بمراكز اعتقال مختلفة في دمشق، ولكن مصيره وزميله محمد ظاظا ومكانوجودهما لازال مجهولاً. وعلى الرغم من الطلبات المتكررة من الأسرة والمحامين،تواصل السلطات السورية نفيها وجودهم في الحجز، مما يضعهم بشكل خاص عند خطر التعذيب

أو غيره من ضروب سوء المعاملة والإعدام خارج نطاق القضاء.

ان الاختفاءالقسري هو جريمة بموجب القانون الدوليواستخدامه في سوريا قد أدين بقوة من قبل مجلس الامن الدولي، الذي طالب أيضاً بقرارهفي فبراير/شباط 2014 بوضع "حد فوري لهذه الممارسات والإفراج عن جميع الأشخاصالمحتجزين تعسفياً."

ان حقيقة عدم وجود أي معلومات عن الوضع الحالي لخليلمعتوق هو مدعاة للقلق الشديد لأسرته والمنظمات الموقعة أدناه، ولا سيما وقد أشارتمعلومات غير رسمية أنه في حالة صحية سيئة للغاية. انه يعاني من مرض الرئة المتقدمولديه صعوبات شديدة في التنفس.

تعتبر المنظمات الموقعة أدناه ان الرجلين كلاهما قدتعرضا للاختفاء القسري. أنهم يعتقدون أن خليل معتوق قد استهدف بسبب عمله المشروع والسلمي في الدفاع عن حقوق الإنسان و يبدو ان اختفاء محمد ظاظا يرتبط بعمله معمحامي حقوق الإنسان.

تدعو المنظمات الموقعة السلطات السورية للإفراج عن خليل معتوق على الفور دون قيد أو شرط. وينبغي أيضا بالمثل الإفراج عنمحمد ظاظا إذا تبين، كما يبدو، انه كان قد اعتقل بسبب عمله في مجال حقوق الإنسانأو لممارسته السلمية لحقه في حرية التعبير.

كما تدعو المنظمات الموقعة الدول الأعضاء في مجلس الأمنللأمم المتحدة لضمان التنفيذ الفعال للقرار 2139، و ذلك من خلال توظيف جميعالآليات ذات الصلة على الفور للتأكد من أن جميع الأشخاص المحتجزين تعسفياً يتمإطلاق سراحهم.
