Malaysia: ISA detainees Badaruddin Ismail and Raja Petra Kamaruzaman released

The International Secretariat of OMCT requests your URGENT intervention in the following situation in Malaysia.

New information:

The International Secretariat of OMCT has been informed by a reliable source of the following information.

On 2 June 2001, Raja Petra Kamaruzaman, the Executive Director of the Free Anwar Campaign was released from detention. His family was contacted by the police and asked to collect him at Kuala Lumpur Police Headquarters at 2.30 p.m.

On 3 June 2001, Mohamed Ezam Mohd Nor (National Youth Chief of National Justice Party), Saari Sungib (Chairperson of the April 14 People's Memorandum Rally) and Hishamuddin Rais (columnist and social activist) were sent to Kamunting Detention Centre for a two years detention order. Also on 3 June, the police informed Bahirah (wife of Ezam Mohd Nor) that Tian Chua Chang (Vice-President - Parti Keadilan Nasional) had been served an order for detention without trial. He was also sent to Kamunting Detention Centre.

On 5 June, Badaruddin Ismail, who had been detained under ISA on 26 April, was released.

Currently, Lokman Nor Adam and Badrul Amin Baharom are still in police custody. Tian Chua Chang, Haji Saari Sungip, Ezam Mohd Nor and Hishamuddin Rais are still in detention, having been sentenced without a trial to two years of imprisonment at the Kamunting Detention Centre.

The International Secretariat of OMCT welcomes the release of Raja Petra and Badaruddin Ismail, but is gravely concerned for the physical and psychological integrity of Lokman Nor Adam, Badrul Amin Baharom, Tian Chua Chang, Haji Saari Sungip, Ezam Mohd Nor and Hishamuddin Rais and urges the Malaysian authorites to reconsider the ISA, as suggested by Shah Alam, High Court Judge and Justice Mohd Hishamudin Mohd Yunus.

Brief reminder of the situation :

Since 10 April 2001, the Malaysian authorities have arbitrarily arrested and detained incommunicado altogether ten pro-reform activists under the Internal Security Act (ISA). In the meantime four of them have been released, but six are still in detention, viz., Lokman Nor Adam, Badrul Amin Baharom, Tian Chua Chang, Haji Saari Sungip, Ezam Mohd Nor and Hishamuddin Rais

Action requested :

Please write to the authorities in Malaysia urging them to:

i. take all necessary measures to guarantee the physical and psychological integrity of the above-mentioned persons;
ii. secure that all those detained be allowed to meet with their relatives and/or lawyers;
iii. order their immediate release in the absence of valid legal charges or, if such charges exist, bring them before an impartial and competent tribunal and guarantee their procedural rights at all times;
iv. guarantee the respect of human rights and the fundamental freedoms throughout the country in accordance with national laws and international human rights standards.
