The International Secretariat of OMCT requests your URGENT intervention in the following situation in Sudan.


Brief description of the situation

The International Secretariat of OMCT has been informed by Sudan Organization Against Torture (SOAT), a member of the OMCT network, of the alleged torture of 20 persons in Sudan:

According to the information received, on 9 November 2004, a group of police and security forces entered the Seraif IDP camp in Hay AlGeer, 4 km west of Nyala, at approximately 11:30pm. It is alleged that the police and security forces used tear gas on the IDPs and beat them with sticks. During the attacks it is reported that some shelters and tents were destroyed. Throughout the attack it is also reported that the IDPs were intimidated and were threatened to leave the camp. The attack reportedly left 300 IDPs wounded and another 100 injured by exposure to tear gas.

The police arrested 20 IDPs: including two children, 11 and 13 years old, and one American Journalist (Ramsfield Cadate). All of those who were arrested were taken to the Nyala Central (Wasat) police station and all of them have been charged under articles 51 (Waging War against the State), 58 (Abetment to Mutiny) and 69 (Disturbance of Public Peace) of the 1991 Penal Code. The 20 IDPs were allegedly subjected to torture during their arrests and while en-route from the camp to the police station. All 21 of the detainees were released on bail on 10 November 2004.

In a separate event, on 14 November 2004 at 3:00am, the police forces in Kalma camp opened fire on IDPs. It is alleged that the shootings were intended to threaten and intimidate the IDPs into complying with forced returns to their villages.

The attack reportedly left one minor and an adult dead and 6 others wounded. Among the wounded is an eight month old baby. The details of those killed and wounded are as follows:

The 6 wounded IDPs are hospitalized and receiving treatment at Nyala Hospital.

The International Secretariat of OMCT is gravely concerned by these two abovementioned events, and calls upon the Sudanese authorities to guarantee the before mentioned persons’, including the charge persons’ and the hospitalized persons’, personal integrities and to bring those charged persons before an impartial and competent tribunal and guarantee their procedural rights at all times. OMCT also urges the authorities to launch a prompt, thorough and impartial investigation into these events, in order to identify those responsible and bring them to justice. Finally, OMCT calls on the authorities to guarantee that adequate reparation is provided to the abovementioned persons and/or the family’s of the victims.


Action requested
Please write to the authorities in Sudan urging them to:

i. take all necessary measures to guarantee the abovementioned persons’ physical and psychological integrity;

ii. bring those charged persons before an impartial and competent tribunal and guarantee their procedural rights at all times;

iii. order a thorough and impartial investigation into the circumstances of their arrest and any allegations of torture, in order to identify all those responsible, bring them to trial and apply the penal and/or administrative sanctions as provided by law;

iv. guarantee the respect of human rights and the fundamental freedoms throughout the country in accordance with national laws and international human rights standards.
