Belarus: OMCT joins call for the repeal of Article 19.16

20 October 2026 :  The World Organisation Against Torture (OMCT)  has endorsed the open appeal initiated by LGBTQ+ House, alongside hundreds of civil society organisations , calling for the repeal of Article 19.16 of Belarus’s Code of Administrative Offences and the protection of LGBTQ+ people’s right to information and assistance.

In force since 19 June 2026, Article 19.16 penalises the dissemination of information considered by the authorities to promote the “attractiveness” of same-sex relationships, gender transition or childlessness, regardless of the audience’s age. The provision’s vague wording threatens access to information about health and rights, freedom of expression and the provision of assistance.

The provision also raises serious concerns for human rights defenders and civil society organisations working to protect LGBTQ+ rights, as it risks further restricting their ability to document violations, provide support and carry out legitimate human rights activities.

In a context of widespread repression, arbitrary detention and documented torture and ill-treatment in Belarus, OMCT is particularly concerned that such discriminatory legislation could further expose LGBTQ+ people and those defending their rights to harassment, persecution and other human rights violations.

The appeal calls on the Belarusian authorities to repeal Article 19.16 and other discriminatory restrictions, end persecution for lawful expression, and ensure access to information and assistance.

It also urges UN mechanisms, the European Union and its Member States to press for the repeal of the provision, seek information on its enforcement, and take the risks faced by LGBTQ+ people into account in their monitoring and engagement with Belarus.

Finally, the appeal calls on states assessing international protection applications to consider risks related to sexual orientation and gender identity, recognising that the absence of official documentation of persecution does not in itself rule out the existence of such risks.
