The International Secretariat of OMCT requests your URGENT intervention in the following situation in Israel.

New Information

The International Secretariat of OMCT is gravely concerned for the physical and psychological integrity of Mr El Aziz, disabled and confined to a wheelchair, who has been in detention since 2nd July 2000, following his arrest at the Erez border crossing.

According to the information received from the Public Committee Against Torture in Israel (PCATI), a member of the OMCT network, Mr El Aziz was prevented from meeting with Counsel from 3rd to 10th July. During this time, on 6th July 2000, Mr. El Aziz's detention was extended for a period of 21 days. On 9th July 2000 an urgent petition was filed to the High Court of Justice demanding that the Order Prohibiting meeting be lifted, although this was rejected on 10th July. This Order was then extended to 22nd July 2000.

The International Secretariat remains gravely concerned by the situation of Mr El Aziz, particularly in light of his disability and ill-health, urges the Israeli authorities to uphold Mr El Aziz’s right to legal counsel and to a fair and impartial trial, as established in the International Covenant on Civil and Political Rights, ratified by Israel.

Brief reminder of the situation

The International Secretariat of OMCT was informed by PCATI of the arrest and detention of a disabled man in Israel.

According to the information received, on 2nd July 2000, Mohammed Mustafa Mohammed Abed El Aziz, 23 years old, a resident of Beil Lahiya, was arrested at the Erez border crossing. He has since been detained in the GSS Interrogation Unit at the Shikma Detention Center. It is reported that Mr. El Aziz is physically disabled. He is incontinent, suffers from erosion of his left heel bone, a broken right ankle, birth defects and weakness in the nerves of his legs. He has difficulty walking and standing and is confined to a wheelchair.

The International Secretariat of OMCT is gravely concerned for the physical and psychological integrity of Mr. El Aziz.

Action requested

Please write to the authorities in Israel urging them to:

take all necessary measures to guarantee the physical and psychological integrity of Mr El-Aziz;
order his immediate release in the absence of valid legal charges or, if such charges exist, bring him before an impartial and competent tribunal and guarantee his procedural rights at all times;
guarantee the respect of human rights and the fundamental freedoms throughout the country in accordance with national laws and international human rights standards.
