Cinq ans après, 122 organisations dans le monde exigent de savoir : « Où se trouve Sombath ? »

Cette date marque le cinquième anniversaire de la disparition forcée du chef de file de la société civile au Laos, Sombath Somphone. En qualité d’organisations signataires, nous exprimons, à cette occasion, notre indignation face à l’incapacité du gouvernement laotien à enquêter de manière indépendante, impartiale, efficace et transparente sur la disparition de Sombath, à révéler le lieu de sa détention et à permettre son retour dans sa famille.

Sombath a été aperçu pour la dernière fois, le soir du 15 décembre 2012, à un poste de contrôle de la police dans une rue très passante de la capitale du Laos, Vientiane. Son enlèvement a été filmé par une caméra de vidéosurveillance près du poste de contrôle de la police. D’après les enregistrements visionnés, il existe de fortes présomptions selon lesquelles la police aurait arrêté le véhicule de Sombath et, en l’espace de quelques minutes, des individus non identifiés auraient fait monter Sombath de force dans un autre véhicule et se seraient éloignés en présence d’officiers de police. Il semble également que ces enregistrements montrent un individu non identifié qui s’éloigne du centre-ville au volant du véhicule de Sombath avant de revenir un moment après.

Le fait que les officiers de police auraient assisté à l’enlèvement de Sombath et ne seraient pas intervenus indique fortement l’implication, ou le consentement, des agents de l’État dans la disparition de Sombath. Malgré ces éléments probants, les autorités du Laos n’ont toujours présenté aucun élément nouveau concernant l’enquête menée dans cette affaire. Bien qu’il affirme dans différents forums internationaux que l’enquête est « en cours », le gouvernement n’a toujours pas publié de rapport officiel sur son avancée depuis le 8 juin 2013.

L’affaire Sombath n’est pas le seul exemple de disparition forcée non élucidée au Laos. Les autorités du Laos n’ont pas été en mesure de fournir d’informations sur le sort réservé à de nombreux autres disparus, ni sur l’endroit de leur détention. C’est le cas notamment pour des militants locaux, victimes de disparitions forcées.

L’incapacité du gouvernement laotien à mener des enquêtes sérieuses dans tous les cas de disparitions forcées constitue une violation des obligations auxquelles il est soumis au regard du droit international en matière de droits humains, notamment de l’article 2(3) du Pacte international relatif aux droits civils et politiques que le Laos a ratifié.

Nous invitons instamment les gouvernements du monde entier à exiger que le gouvernement laotien fournisse immédiatement des informations sur le sort de Sombath et l’endroit actuel de sa détention, et sur tout autre détail concernant sa disparition forcée et les autres cas de disparitions forcées, afin de déterminer le sort et la localisation des victimes. Les autorités laotiennes doivent s’engager à ce que les résultats de l’enquête soient accessibles aux membres de la famille des disparus. Elles doivent également renseigner régulièrement le public sur l’avancée de l’enquête pour tous les cas de disparition forcée. Le gouvernement laotien est également tenu de veiller à ce que la responsabilité des auteurs de disparitions forcées, indépendamment de leur titre ou rang, soit établie dans le cadre de poursuites judiciaires engagées dans le respect des normes internationales en matière d’équité.

Enfin, nous incitons vivement le gouvernement laotien à ratifier la Convention internationale pour la protection de toutes les personnes contre les disparitions forcées, d’ajouter ses dispositions à la législation intérieure du pays et de les mettre en application.
