Nabeel Rajab sentenced to five more years in prison for tweeting in unfair trial proceedings, according to trial observation mission

Prominent Bahraini human rightsdefender Nabeel Rajab was sentenced to a further five years in prison on21 February 2018, during a verdict that an observer called unusual, as thelawyer was not allowed to speak during the brief proceedings. Rajab was ontrial at the High Criminal Court of Bahrain for tweeting about the war in Yemenand poor conditions in Jaw Prison. Rajab has already been sentenced to twoyears in prison in a separate case for media interviews, and has beenimprisoned since his arrest on 13 June 2016.

Rajab is one of the founders andcurrently President of the Bahrain Centre for Human Rights (BCHR), as well as aFounding Director of the Gulf Centre for Human Rights (GCHR), Deputy SecretaryGeneral of FIDH, and a member of the Human Rights Watch MENA Advisory Board.

An international observer attendedthe court hearing on behalf of GCHR, the Observatory for the Protection ofHuman Rights Defenders, a partnership of FIDH and the World OrganisationAgainst Torture (OMCT), Front Line Defenders, English PEN, and BCHR. Theobserver reported that the court proceedings were very short and Rajab’s lawyerJalila Al-Sayed was not allowed to speak, which contravene internationalstandards of due process. The verdict was also attended byrepresentatives of the United States, British, and German Embassies, who havebeen regularly observing Rajab’s trials.

Rajab, who was in court, looked athis lawyer when the verdict was announced and flashed the sign for perseverance(Sumood). Local sources had predicted that Rajab would be sentenced to fiveyears in prison, but with elections coming up in October 2018 there were hopesthat his sentence would be lower or the case would be dropped. He has the rightto appeal but has indicated that he will not do so.

Rajab was first arrested in thiscase almost three years ago. On 02 April 2015, security forces surroundedRajab’s home and arrested him in relation a series of tweets and an opinionpiece published in the Huffington Post. The first charge was for“offending national institutions” in connection to his documentation ofmistreatment and torture in Bahrain's Jaw Prison in March 2015. The secondcharge of “spreading rumors during wartime” related to his reporting oncivilian deaths in Yemen, in contravention of a government prohibition of anypublic mention that is critical of the conflict. He was also charged under theBahrain penal code with “offending a foreign country” (Saudi Arabia).

Rajab was facing up to 15 years inprison for this case (10 for the Yemen tweets and five for the Jaw prisontweets). Bahrain’s penal code provides for up to 10 years in prison for anyonewho “deliberately announces in wartime false or malicious news, statements orrumours.”

On 15 January 2018, the Court ofCassation upheld the two-year prison sentence against Rajab in the media caseon charges of "disseminating false news, statements and rumours about theinternal situation of the kingdom that would undermine its prestige andstatus." On this sentence alone, he will remain in jail until December2018, even though he has now been in jail already since June 2016.

Rajab has been poorly treated inprison and had surgery at the Bahrain Defence Forces (BDF) hospital. Followingone surgery in April 2017, the wounds became infected and he was returned tohospital. He has a number of health conditions, including heart problems andhigh blood.

On 25 October 2017, Rajab wastransferred from hospital to Jaw prison. He is being held in a segregated wingof Jaw Prison in the same cell as five convicted high-ranking Da’esh (ISIS)members, all of them from the Bin Ali clan. They are serving sentences from 15years to life sentences. Three years ago, Rajab was charged over tweetscriticising Bahrain for turning a blind eye on the rise of ISIS. In his tweetshe referred indirectly to the same Bin Ali clan.

The Observatory for the Protectionof Human Rights Defenders (FIDH-OMCT), GCHR, Front Line Defenders, English PEN,and BCHR call on the authorities to:

Immediately and unconditionally overturn the sentencesagainst Nabeel Rajab and free him, as these sentences and his detention arearbitrary since they only aim at sanctioning his human rights activities;

1. Provide all necessary medical care, and access to his family and lawyers;
2. Ensure that judicial proceedings in Bahrain adhere to international standards of fair trial; and
3. Guarantee that human rights defenders may work freely without persecution in Bahrain.

تم الحكمعلى المدافع عن حقوق الإنسان البحريني البارز نبيل رجب بالسجنلمدة خمس سنوات أخرى في ٢١ فبراير/شباط ٢٠١٨، خلال جلسة النطق بالحكم التي وصفهاالمراقب الذي حضرها بإنها غير عادية، حيث لم يسمح للمحامية بالتحدث خلال الإجراءات المختصرة.مثل نبيل رجب أمام المحكمة الجنائية الكبرى في البحرين لتغريداته عنالحرب في اليمن والظروف السيئة في سجن جو. وكان قد حُكم على نبيلرجب بالسجن لمدة سنتين في قضية منفصلة لمقابلات إعلامية اجراها، وقد تم سجنهمنذ اعتقاله في ١٣ يونيو/حزيران ٢٠١٦.

ويعد نبيل رجب أحد مؤسسي مركز البحرين لحقوقالإنسان، بالإضافة إلى كونه مدير مؤسس لمركز الخليج لحقوق الإنسان، ونائب الأمينالعام للفدراليةالدولية لحقوق الإنسان، وعضو المجلس الاستشاري لمنطقة الشرق الأوسط وشمال أفريقيافي منظمة هيومان رايتس ووتش .

وحضرمراقب دولي المحكمة نيابةً عن مركز الخليج لحقوقالإنسان، مرصد حماية المدافعين عن حقوق الإنسان، وهو شراكة بين الفدراليةالدولية لحقوق الإنسان والمنظمة العالمية لمناهضة التعذيب، فرونت لاين ديفندرز،مركز القلم الإنكليزي، ومركز البحرين لحقوق الإنسان. وذكر المراقب أن إجراءات المحكمة كانت قصيرة جدا ولم يسمحللمحامية جليلة السيد بالتحدث، مما يتنافى مع المعايير الدوليةللإجراءات القانونية الواجبة. وسيصدر تقرير كامل عن جلسة الاستماع في المستقبل.

وحضر المحكمة أيضا ممثلون عن السفارات الأمريكية،البريطانية، والألمانية، الذين كانوا يراقبون بانتظام محاكمات رجب.

وابتسم نبيل رجب، الذي كان في المحكمة، لمحاميتهعندما أعلن الحكم وأشار بعلامة الصمود. لقد توقعت مصادر محلية أن يحكم على نبيلرجب بالسجن لمدة خمس سنوات، ولكن مع الانتخابات التي ستجرى في أكتوبر/تشرين الأول ٢٠١٨ كان هناكأمل في أن تكون عقوبته أقل من ذلك أو سيتم إسقاط القضية. أن له الحق في الاستئناف ولكنه أشار إلى أنه لن يفعلذلك.

وكان نبيل رجب قد اعتقل للمرة الاولى فى هذه القضية قبل ثلاثةاعوام تقريبا. وفي ٠٢ أبريل/نيسان ٢٠١٥، حاصرت قوات الأمن منزل رجبوألقت القبض عليه في إطار سلسلة من التغريدات ومقال رأيٍ نُشر في صحيفة هافينغتون بوست. وكانت التهمةالأولى التي وجُهت له هي "الإساءة للمؤسسات الوطنية" فيما يتعلق بتوثيقهلسوء المعاملة والتعذيب بسجن جو في البحرين بشهر مارس/آذار ٢٠١٥. (انظر التقرير: داخل جو: وحشية الحكومة في سجن البحرين المركزي). أما التهمة الثانية فتتمثل في "نشرالشائعات أثناء الحرب" وتتعلق بحديثه عن وفيات المدنيين باليمن، في إنتهاكلحظرٍ حكومي لأي ذكر عام ينتقد الصراع الدائر في اليمن. وأتهم أيضا بموجب قانونالعقوبات البحريني بتهمة "الإساءةإلى بلد أجنبي" (السعودية.(

كاننبيل رجب يواجه السجن لمدة تصل إلى ١٥ عاماً في هذه القضية (١٠ لتغريداتٍاليمن وخمسة لتعليقات سجن جو). وينص قانون العقوبات البحريني على عقوبة السجن لمدةتصل الى عشر سنواتٍ لكل من "يعلن عن عمد في وقت الحرب أخباراً كاذبة أو كيدية، بيانات، أو شائعات."

وفي ١٥ يناير/كانون الثاني ٢٠١٨، أيدت محكمة التمييزالحكم بالسجن لمدة سنتين ضد رجب في قضية الإعلام عن تهمة "نشر أخبار كاذبةوبيانات وشائعات عن الوضع الداخلي للمملكة من شأنها أن تقوض مكانتها." وبسببهذا الحكم لوحده، سيبقى رجب في السجن حتىديسمبر/كانون الأول ٢٠١٨، يالرغم من كونه قد سُجن بالفعل منذ يونيو/حزيران ٢٠١٦.

لقد واجه نبيل رجب معاملة سيئة في السجن وأجريتله عملية جراحية في مستشفى قوات الدفاع البحرينية. وبعد عملية جراحية فيأبريل/نيسان ٢٠١٧، أصيبت الجروح بإلتهابات وأعيد إلى المستشفى. ولديه عدد منالعوارض الصحية الصعبة، بما في ذلك مشاكل في القلب وارتفاع ضغط الدم.

وفي ٢٥ أكتوب/تشرين الأول ٢٠١٧، ُنقل رجب من المستشفىإلى سجن جو. وهو محتجز في جناح منفصل عن سجن جو في نفس الزنزانة التي تضم خمسة منأعضاء داعش ذوي الرتب العالية، وجميعهم من عشيرة بن علي. انهم يقضون أحكاماً بالسجنلمدة ١٥ عاماً. لقد أتهم رجب قبل ثلاث سنوات وذلك بسبب تغريدات تنتقد البحرينلغضها الطرف عن صعود تنظيم داعش. وأشار في تغريداته بشكل غير مباشر إلى عشيرة بنعلي.

يدعو مرصد حماية المدافعين عن حقوقالإنسان، بالشراكة بين الفيدرالية الدولية لحقوق الإنسان والمنظمة العالميةلمناهضة التعذيب، مركز الخليج لحقوق الإنسان، فرونت لاين ديفندرز، و مركز القلمالإنكليزي، ومركز البحرين لحقوق الإنسان، السلطات في البحرين إلى:

1. إلغاء العقوبات ضد نبيل رجب وأطلاق سراحهفوراً ودون قيد أو شرط؛

2. توفيرالرعاية الطبية الضرورية الكاملة له، واعطائهحقه في الوصول و التواصل مع أسرته والمحامين؛

3. التأكد من أن الإجراءات القضائية في البحرين تتماشىمع المعايير الدولية للمحاكمة العادلة؛ و

3. ضمان أن المدافعين عن حقوق الإنسان يمكنهم العملبحرية دون الاضطهاد في البحرين.
