Pronunciamiento conjunto: Exigimos el fin de la política sistemática de criminalización a defensores y defensoras de derechos humanos en Venezuela

We call forthe guarantee, respect, and promotion of the work of human rights defenders

(Caracas.February 21, 2020.) The human rights organizations and individuals whosign this statement condemn the attacks and aggressions committed against thosewho defend human rights and do humanitarian work in Venezuela. We demand theimmediate end to the policy of criminalization carried out by officials of theVenezuelan State. The right to defend human rights must be guaranteed,protected, and promoted in Venezuela.

Since 2002,State authorities have developed a policy of criminalization of the defense ofhuman rights. Through the use of hateful and slanderous speech, broadcastedthrough public and State media, officials pretend to discredit the work oforganizations and persons who defend human rights, accompany victims, and takehumanitarian action. These acts have promoted the execution of violent actionswhich affects the work of defense of human rights, as it puts the life andpersonal integrity of those who have been affected by the Venezuelan crises andcreate additional obstacles to this line of work.

For thepast 5 years, the attacks against the Venezuelan human rights movement haveobeyed to the thesis of the alleged existence of an internal enemy who seeks todestabilize the peace of the nation. As a result, the movement has beenaffected, not only by stigmatization and the attempts of delegitimizing humanrights work through hateful and slanderous speech, but also by the applicationof restrictive legislation, legal action, aggressions, digital attacks,persecution, arbitrary raids, arbitrary detention, criminalization ofinternational cooperation, the confiscation of materials, amongst otherattacks, which has harmed and hindered the defense of human rights.

Thepolicies of repression and control have facilitated the abuse of authority bypublic officials, many of a high rank, generating a hostile environment which,amidst a complex humanitarian emergency, makes the legitimate work of civil societyorganizations increasingly difficult. This situation also inhibits victims fromdenouncing violations or seeking assistance, in addition to exposing them tothe violence and insecurity given the high crime and impunity rates.

Organizationsthat promote and defend the right to health, food, people who do humanitarianwork, medical assistance, and nursing professionals have been victims ofharassment and reprisals, arbitrary raids, arbitrary detentions and aggressionin the past two years after denouncing abuses in support of vulnerablepopulations. They are considered to be agents who promote militaryintervention.

There hasalso been an upsurge in the repression against unionists and workers, who havebeen victims of persecution, incarceration, threats, and aggression. Indigenousand environmental human rights defenders have also been victims of harassmentand reprisals for reporting the abuses caused by the exploitation of naturalresources in the Arco Minero del Orinoco and other areas of the country.Community organizations and activists, students, and committees of victims havealso been subjected to threats as a reprisal for demanding the restoration oftheir rights or for denouncing violence and abuses in their communities and dailyspaces.

In thiscontext, it is necessary that in Venezuela, those of us who defend human rightscan do so in a safe and conducive environments, which guarantee that we mayengage in our peaceful and legitimate activities without undue restrictions orfear of harassment, threats, or reprisals.

For thesereasons, we demand that the Venezuelan State:

1. Immediately cease all forms of criminalization,intimidation, harassment, delegitimization, and aggression. We also demand thatthe State abstains from imposing arbitrary limitations and restrictions to the rightof association and freedom of assembly.

2. Implement the necessary mechanisms to promote andguarantee a conducive and safe environment for those who defend human rights inVenezuela, along with the creation of effective mechanisms for the protectionof those who defend human rights.

3. Take everymeasure necessary to ensure that State officials, and other public figures,abstain themselves from making declarations which stigmatize the legitimatework of human rights defenders.

4. Investigate and sanction those responsible forcommitting aggressions against human rights defenders in Venezuela, both Stateactors and non-State actors.

5. Effectively apply the “Declaration on the Right andResponsibilities of Individuals, Groups and Organs of Society to Promote andProtect Universally Recognized Human Rights and Fundamental Freedoms”, known asthe Declaration on human rights defenders, adopted by the United NationsGeneral Assembly on the December 9, 1998.
